Srinagar, July 09 (GNS): The State Human Rights Commission (SHRC) on Tuesday issued a balliable warrant against Deputy Secretary to Government for failing to appear in the case of continuous detention and imprisonment of JKLF chief Yasin Malik.
SHRC member Dishad Shaheen issued the warrant on a petition moved human rights activist Ahsan Untoo.
The petitioner pleaded that despite notice to Deputy Secretary Home Department has not been responding.
“Issue a balliable warrant of arrest to Mushtaq Ahmad (KAS), Dy. Secretary to Govt. (Home) Department in the amount of Rupees 2000 to be executed by SHO P/S Shaheed Gunj”, reads an order issued by SHRC member, a copy of which lies with GNS.
The matter has been posted again on July 15 .
The petitioner seeks the release of JKLF chief under PSA, which according to him is a gross violation of human rights and was against international human rights conventions.
The petitioner stated that Malik was arrested on “frivolous charges” and was later slapped with PSA. He was sent to Kot Balwal Jail in Jammu without following the law laid down by the Supreme Court which categorically states that any person who is detained under preventive custody has to be lodged at the nearest jail to his/her home.
The petitioner also stated that Malik is suffering from various ailments and needs continuous medical check-up by specialised doctors. Untoo said that despite the state being aware of the health problems of the detainee, he was shifted to outside jail.
He further submitted before the Commission that Malik was a well-known political personality and his pleading the just cause of people was no crime.
Untoo demanded that Yasin Malik be shifted back to Srinagar as early as possible in the interests of justice. (GNS)
